In a bank auction, the bank provides the title documents they hold. However, 'Trust but Verify' should be your motto. Just because a bank gave a loan doesn't mean the title is flawless.
Steps for Title Verification
- Chain of Deeds: Trace the ownership back at least 30 years. Ensure every sale deed flows logically to the next.
- Sub-Registrar Search: Verify the documents provided by the bank against the records at the SRO (Sub-Registrar Office) to ensure they are genuine.
- CERSAI Search: The Central Registry of Securitisation Asset Reconstruction and Security Interest (CERSAI) maintains a database of all mortgaged properties. A CERSAI search prevents the fraud of 'multiple mortgages' on the same property.
Always hire a specialized property lawyer to issue a 'Title Search Report' before participating.
